  • How to expedite/fasten K1 process?

    Hello!

I've filed and applied for my fiance visa on 11/18/2013. We currently plan to get married overseas on 4/26/2014. I'm just worried that her visa won't get processed and approved in time for our wedding and then she remains in her home country while I fly back to United States by myself even though we're now a married couple. That will be a disaster.

I'm just wondering if there's a way we can expedite/fasten the visa process for her. She has lived in Unites States since she was 17 and lived for more than 13 years as student and working professional. I'm naturalized US citizen and now work for US Federal Government (not in armed forces). Can I somehow use my employer to fasten her process? Or we just simply have to wait and hope for the best?

For example, when I called the USCIS a week earlier, the agent told me that I can submit my ticket to her country and/or honeymoon trip document as ways to expedite and process in time for the wedding. Not sure that really works.

    Any help would be appreciative.

If you are petitioning her for a fiancee visa, why are you planning to marry outside the U.S.? If you bring her to the U.S. on a K1 visa, then leave to marry somewhere else, you'll have to petition her again as a spouse and wait another 8 months or so.

We'll get married again in United States when she comes, then we'll file for her permanent residency.

I am no expert, but I am pretty sure you cannot get a K1 once you marry. Submitting wedding plans means nothing. If the submitted wedding plans are for outside the USA then I think they will hinder your case. I think you are doing it the hard way despite your good intentions. You should withdraw the K1, get married, and apply for a spousal visa. It will be a lot easier.

I submitted my K1 petition last October. We still do not have an interview. There is nothing you can do.

          Jiwonstr,

I have to agree with linuxpro. If your gal uses a fiancee visa to enter the U.S. after she has been legally married to you, visa fraud by misrepresentation will have occurred and can result in deportation and a future bar from reentry may result.

I petitioned for a K1 for my fiancé because we do plan to marry in the USA. Entering and marring using any other visa can be mis-interpreted as fraud.

We do not plan to stay in the USA, so some feel the B2 may have been a better choice. I do not want to take chances, so I chose the K1.

You should try to match the visa to your intentions as best you can so that your intentions are not misunderstood.
