    Hi everyone,

    I am an Indian citizen and work in Bangalore. My parents are looking for suitable matches for me in India as well as in the US.

    I have some queries:

    1. In case if my to-be wife is a US citizen of Indian origin and we get married in India, am I am eligible for a US visa that will allow me to apply for employment in the US ?

    2. In case if she is an Indian citizen but holds a green card, then will I be eligible for a US visa that will allow me to apply for employment in the US ?

    3. If she has a H1-B visa, then am I eligible for a visa that allows me to work in the US ?

    Kindly advice me.

    1. yes, after marriage, she will have to file for a permanent visa for you in US ( I-130). you will get it in a few months from US embassy /consulate
    in India. Then you can go to US with that permanent visa , you will get a green card and work there.
    2. The process is the same as 1 but there is a few years wait for the permanent visa .
    3. You will get an H-4 visa , but you cannot work on an H-4 visa.
    If you want to work , you will have to find an employer in US who can file for an H-1 for you and change from H-4 to H-1.

      Thank you very much Peace999 ! One more follow-up question, you mentioned that there is some wait before getting the permanent visa if you are married to a green card holder. Am I eligible to work during this time, i.e. before I get the permanent visa ?

        You will only be able to go to US when you get your permanent visa in India filed by your green card wife, a few years later.

        So question of working does not arise.

        Yes, if you can go on another visa to US like H-1 or L-1 on your own, you can work there while also waiting for the green card filed by your green card wife.
