  • To bring my Australian boyfriend to America - Any assistance would be welcomed!

Hello everyone, I am fairly new to the information needed for the K-1 visa, and I would like to ask for some assistance.

I am an American citizen of 21 years and am dating an Australian man of 23 years (for the last 7 years).

We met online approx. 7 years ago and became inseparable ever since. 3 years into our relationship, we finally met each other in person for the first time (after endless chats and skype calls of course) during Christmas for around 2 weeks (it was a lot of fun). Ever since then we'd periodically come to visit each other, and all together we've physically seen each other for around 8 months total (him to visit me 3 times, total for 4 months, and me to him 2 times, for a total of 4 months).

We talked during the end of my most recent visit (this year for 2 months), and decided we are ready to stop the visiting and get into moving in together.

We feel in terms of coming to America, that the easiest thing to do would be the K-1 visa. I am well aware of the major ideals of the visa: get the visa through, come to America, marry within the 90 days, then wait for the interview/do the interview, have it pass (hopefully) and then fill out further visas until full residency. Though my question is is that do we need an actual ceremony for the marriage? Or would it be okay to get legally married and have the ceremony at a later time (we don't feel quite ready getting married married yet, but we would be fine with being legally married and have the ceremony at a later date).

Currently my living situation is with my mother (she adores him and is fine with accommodating for him) until we raise enough money to live on our own with suitable living conditions. I am currently not working, and even if I was working (a retail job of some-sort), it wouldn't be enough to fulfill the requirement needed to be a proper sponsor, though from my understanding, I can have a co-sponsor to help me with funds. Is this correct?

He also hasn't fully passed high school. From my research, it isn't required to have a full diploma to come to the states (and I'm not fully sure if it's needed to get a job, though I know it might be needed). Is this true?

He also hasn't been working (at all really) for 2 years, I read somewhere that might be an issue for a green card, would that cause any issues for the K-1 visas?

Those are all of my questions, so to reiterate -

    1. In order to do the K-1 Visa, is an actual ceremony required for the marriage?
    2. I am currently not making enough money to fully sponsor him coming to the country, would my mother be able to be his co-sponsor for the visa?
    3. Is having a high school diploma needed for coming to the country through this visa?
    4. Would not having any work experience from him be an issue for this visa?

Thank you very much for your time and assistance!

NO, JUST A COMPLETION OF THE MARRIAGE REQUIREMENTS.

    2. I am currently not making enough money to fully sponsor him coming to the country, would my mother be able to be his co-sponsor for the visa?

    YES.

    3. Is having a high school diploma needed for coming to the country through this visa?

    NO.

    4. Would not having any work experience from him be an issue for this visa?

    NO.

Thank you very much for your time and assistance!

I also have another question regarding to the visa.

Through the process of the K-1 Visa, does my boyfriend loose his Australian residency?

We just want to make sure that if there are any potential problems, that he can go home without any issues.

There is no adverse effect on your boyfriend's Australian residency or citizenship status when using a U.S. fiancee visa.

Permanent residency in the U.S., however, can limit Australian pension benefits.
