My fiance has only just started a full time job paying 20k per year. After 3 months have passed, we will be applying for our K-1 Visa.

There is just one thing which is worrying me. Say the K-1 gets accepted and I go out there to marry him. Once we file the AOS, he will have no tax returns to give them as this is his first full time job. (Accept the one that he files at the end of this year, I'm not 100% when your supposed to file them as I'm from the UK)

When we file the AOS, is it likely to be declined because he cannot produce 3 years of tax returns?

Only the most recent year Federal income tax return (or transcript) is required for sponsorship.

Thank you. When do American's file their tax returns? I don't have to do that here in the UK as it automatically comes off what I get paid each month.

In the U.S., tax returns are normally filed anytime between Janaury 1 and April 16, for the preceding calendar year. Extensions in filing are allowed through October 16.
