  • K1 Work Permit advice

    Hi! My fiance and I are currently in the process of filing for a K1 visa. He is from the UK and I'm from the USA. I understand that once we are married within the 90 day period he is eligible to apply for a work permit. What we didn't know is that it can take anywhere from 3-6 months for the work permit to process, which is not the best news to find out. Is there such thing as a temporary work permit? What do people do while they are waiting for the permit to go through? Help! Thank you!

    Another thought--Even though my petition is pending at the moment, what if i went to London and we got married, could he then apply for a work permit in the US to speed up the process or is that not legal?

    There are two kinds of Work Authorizations that K1 entrants can obtain:

    1. A Work Authorization to permit work during the 90-day visa period. HE DOESN'T NEED THIS! After being in the U.S. 15 days, he is eligible to apply for an SSN and can then legally work for the duration of his 90-day visa period without an EAD.
    2. The interim Work Authorization, good for one year, that comes about 3 months after you apply for Adjustment of Status (his Green Card). After the Adjustment of Status is approved (with or without an interiew), usually about 6 months after application, his Green Card takes the place of the Work Authorization, which he no longer needs.
