  • Quick Proedure I-130 / I-485

    I am great admirer of this website and have always got useful answers of all queries from Ray and Peace. I would like to thank you both of you

    I am describing my whole situation so for the last time I can get complete with error free information.

    My wife is US citizen and residing in TX. She is preparing forms and collecting documents and going to file I-130 within this week. As per my research immigration normally takes 5 – 8 months but she is alone and want me in US as early as possible.

    We would like to know either she file I-130 alone or along with I-485. Main agenda is she want me in US as soon as possible so now what steps we can take and which forms will be required.

    If you are going to be processed for an immigrant spousal visa while outside the U.S., an I-485 cannot be used (nor the $1,070 fee paid). All that your wife need do is submit an I-130 ($420 fee), and the subsequent processing will take 7-11 months for a visa to be processed.

      Ray,

      I understood your point and will follow the same. What about nonimmigrant visa for spouse who just want to visit
      in order to reduce physical distance even for short time period like one or two months.

        Your wife can apply for a visitor visas (B2), but her existing marriage to a U.S. citizen might be interpreted as an "intent to immigrate," a common reason for denial of a visitor visa.

          Ray,

          I told you in the beginning my wife is divorced. As discussed earlier she is preparing documents to file I-130 to bring me in USA. In the passport and citizenship certificate she has ex husband name. Now pls guide us does she need to change her name over to fathers name again or she can proceed with her ex husband name.

            As far as U.S. requirements are concerned, it doesn't matter if she reverts to her maiden name or continues to show her last married name on her various documents.
