  • HELP! K-1 Visa 3rd Country National

    I am a US citizen and my fiance is a native of Nigeria but has been in China on a work visa for about 3 years. He prefers to use his Nigerian mailing address and also travel back to conduct his interview there. However, we want to be as transparent as we know how. With that, we would also like USCIS to know that he does have living arrangements in China but has a home in Nigeria. He is nervous that they will make him do everything through the embassy in China, which he really wants to avoid due to the possible headache. We are concerned that they will be confused if we put both of his addresses on the G-325A Biographic Information for, typing in "Pres" instead of a date for his Nigerian address (which would be on the 2nd line of his past residences).

    Also, he has traveled to many countries and lived and worked, would he need police reports from each? Would his travel/moving/job changes reflect negativity? How deep do they go in connecting work/living history dots? Would they go as far as requiring old visas, etc?

    I have searched the form for this subject matter and saw a few post but no replies. We really want to dot all our "i"s and cross all of our "t"s. Any help you can give will be GREAT!

    You have several questions.
    1. On your I-129F, show a Nigeria address at which your guy can receive mail. That must be his official address with USCIS.
    2. On his G-325A, show both the Nigeria address, but his China address as temporary address.
    3. For his eventual interview, he will have to provide police clearances for any countries he has worked or lived in since age 16. Some countries, however, will not provide police clearances. China will.

      THANK YOU! I actually wished you would respond... you are quite informative (I noticed your other post). Thank You!

      One more question: If I desire for him to come for a visit in December (to meet my family in person), should we apply for K-1 and B-2 (visiting visa) at the same time -or- should one be submitted and waited on for a reply? Someone told me today that if you are denied for one, the other will automatically be denied and we will have to wait two years to apply. Please advise.

        If your fiancee is denied for a visitor visa, it is a "denial without prejudice," and should not stand in the way for other visa applications in the future. Whoever told your friend that a denial would require a wait of two years is probably smoking too much ganja.

        If any mention is made of visiting a fiancee or if a fiancee petition has been submitted, a visitor visa will probably be denied because of "intent to immigrate" having been "expressed.

          Shoot! So we either have to apply for the B-2 and wait until it is approved then K-1

          just do K-1 only?
