  • Can my husband sponsor my children if they live in a different state?

    I divorced my ex-husband years ago. After the divorce I sent two of my children to study abroad in the US because I don't want them to see their parents apart. I met my boyfriend about 3 years ago when I visited my country. We're married for a month now and he would like to sponsor me and my children (his step-children; they're both under 18) to the US (they are currently in the US already on F-1 visa). He will file form I-130 for me, and as soon as it's accepted I will enter the US. My question is:

    He lives in California. My two children are in their first year of college in New York. Because of their programs, they cannot transfer now or else they have to restart the whole thing. Can he still sponsor me (we will live in California together) and my children if they're living in New York and don't plan to move to California in the near future? I've read somewhere it says spouses must live in the same house, but I can't find any information about whether or not his step-children have to stay in the same house as him. Thanks.
