    Hi all,

    Really hoping to get this answered. Here is a brief explanation before my question:

    My fiance is in Vietnam. She is legally divorced. She has 3 children. 2 children are from her marriage (father has custody of son, fiance has custody of daughter). The third child is from another man she doesn't want to have anything to do with. She has a birth certificate for this child and it has her maiden name on it. Nothing about the father. The father is a vietnamese citizen in the UK (in case it matters).

    So, question is this:

    When I complete the form i-129f for 3 children, how do I manage this? The first to children are easy because of divorce. But the third child is not from a marriage. The form shows only to add children of my fiance and past marriage. But, the third child is not from the marriage so, to leave it as t he form shows, it could be construed that the child also comes from the first father.

    So, how do I do this? Do I just have her get the passport for the child and birth certificate? And write a letter explaining about the child's father? My fiance does not want anything to do with him and I know why and understand.

    There is no requirement that children of your fiancee must be from a prior marriage. Just list the child's name, dob, birth country and address on page 3 of the I-129F and include a copy of that child's birth cert (with certified English translation).

      Thanks Ray! About the comment of "with certified English translation", what do you mean? A birth certificate that has English and Vietnamese?

      My concern is that the US side of things will want to get signed releases from the father for the children to leave Vietnam. And the father of the first 2 children will do that, but there is no father for the third child (at least we are not showing this) to dispute or have something signed. She had the birth certificate made with her family name, and never included the father (basically, he is a deadbeat and she wants nothing to do with him).

        Normally, the USCIS and HoChiMinh U.S. Embassy are not concerned with absent parent approvals, though this could vary by country.

        Initially, good photocopies of birth certs in Vietenamese will be needed for the petition submittal, accompanied by separate professional English-language translations.
