Hello everyone,
I am about to get married in India in February 2015, and plan to file the spousal visa application from the US when I get back. My spouse has visited the US before on a tourist visa. Can she come here with me after she gets married, and stay with me while I file the application, and then go back when her visa interview is scheduled in India? The benefit is that I get to be with my wife as she can travel here legally on a tourist visa (but not immigrating). When she will be coming here, she will be traveling on a visiter visa, but the I-130 won't be filed until we get back to the US. So thats still legal, and she can go back when her date comes.
What are my best options? Is there a possibility of immigration issues? Any other options that I am not considering? Any resources or lawyers that you know of that I can consult? Are there any legal problems at the airport when she is going back to India?
