  • submitted I-129f with incorrect info

    Hell all,

    I filled out form i-129f incorrectly, hence my fiancé just told me that he was divorced after the form was sent and received NOA1. Please advise what should I do? Should I write the letter to amend marital status in I-129f with divorced certificate Or should just wait for USCIS request for further action?

    Was your fiancee's divorce FINAL after you submitted the I-129F, or was there no mention of his divorce on the I-129F? If no mention on the I-129F, was there an entry for his prior marriage on his G-325A?

      Thank u for the quick response, the divorced was final but he embarrassed to tell me earlier since he has single certificate after divorced final so he thought could be ok to filled single, also for form G235a he didn't mention about his previous marriage. His divorced final 2yrs ago.

        Send an amendment to the USCIS address that will be on your hardcopy receipt from USCIS. The amendment, with a copy of the hardcopy receipt, should be accompanied by a copy of the divorce document with an explanation that the prior marriage information was mistakenly left out of the original application. Don't try to over-explain the omission.

        It is better to try and fix this early on, rather than have it come up in an Embassy interview and be interpreted as misrepresentation.

            Hello Ray,

            I have received email notification that i129f has approved didn't get the hard copy yet, also not sure if they even receive my amendment letter. In this case if they didn't receive it would it be a problem at embassy? My fiancé will fill out the divorced info in form DS-230 once we got the package 3.

              Pink,

              Your fiance will be filling out DS-160. The DS-230 isn't being filled out anymore, except as an internal document at some Consulate(s). For immigrant visas, the DS230 has been replaced by the online DS-260.

              Your fiance will need to take a copy of your divorce doc and amendment request to his interview.

                Thank u very much Ray, the process gone so fast now and we are worries that we will fail since some info were missing. They might give him a red flagged. One more question!! Should I fill out the i129f signed and date again? And give him to bring to interview.

                  No, just a statement labeled "Amendment to I-129F and G-325A," signed and dated, with an explanation for what happened and including a copy of the divorce document attached.

                    Now, fingers crossed hope everything go well. Still couldn't believe the NOA2 received in 22 days after i129f was submitted.

                      Oh one more!! Does the letter need to be in details like why/how we missed that info? Or just a very polite amend letter where it need to be amended?
