    Hello guys,

    I am currently trying to understand what the quickest way is to bring my girlfriend to come to USA.

    My status - i am US Citizen, i live an work in US.

    Her status - She is Bosnian, has Bosnian citizenship, currently living in Sweden, she works there.

    Can i apply for her tourist visa or is this something that she can do while in Sweden? Can she go to US embassy in Sweden and apply for tourist visa?

    We plan to get married when she comes to US, can she get married under the tourist visa, and then apply for permanent stay in US?

    I also understand that there is an option to apply for immigrant visa, which would give her permanent stay and work, but i am not sure how long is the wait for her to obtain something like this? Would getting tourist visa be fastes process for her to come to US?

    Go visit your gal in Sweden, then submit form I-129F with supporting documents and $340 fee. Processing will take about 8 months

      Thanks Ray,

      I have just been to Sweden for the Christmas and New Year and spend time with her, i can certainly go again but what is the reason, am i required to sign the form and submit it while in Sweden?

      Also can she come to US once the form I-129F is submitted or does she have to wait for complete process to finish before she is allowed to come to US?

        Since you have already met in person, and have proof of being together in person, you can now prepare and submit a fiancee visa package without returning to Sweden.

        Your fiancee would have to wait until the fiancee petition is approved Stateside and gets to Sweden for her to be processed for a visa at the U.S. Embassy in Sweden.

          Thanks Ray, here is my last question, what about if she came under tourist visa and she got married here? I been reading on this and i understand that there are also forms that she can submit to change her status under tourist visa? I know this would be avoiding the process of applying directly for fiance visa, but at least it would allow her to stay here in US while she is waiting for the papers to process. We are trying to avoid for her to wait 8 months in Sweden and see if she can come and stay here.

          And i think obtaining tourist visa would be faster for her to come to US, i think. is this true?

            If your gal comes to the U.S. on a visitor visa and you later marry her here, then submit an immigrant petition, she can return to Sweden to be processed or an immigrant visa, or you can convert her status while she remains here.

            Keep in mind that planning to convert her status while she is here on a visitor visa is considered "intent to immigrate," and would be a valid reason for denying her visitor visa or entry to the U.S. on a visitor visa or visa waiver (ESTA).
