  • Fill the petition I-129F before completing the two-year home residency requirement

I was in the U.S. under the J-1 visa and now I need to wait for the two-year home residency requirement, but my girlfriend and me are intend to get married. We are willing to wait for the two years because we know is hard to get the waiver. She has to send the Form I-129F, Petition for Alien Fiancé, to the USCIS, and just after the approval of this petition I can apply for a visa here in Brazil.

I left the U.S. in December 16 (2014), so it means that the two-year home residency ends in December 16 (2016). However, I would like to know if she has to wait until December 16 (2016) to send the petition to the USCIS, or if she can send before (like July 2016). I am wondering if the date thatreally matters is the date of when I am going to be interviewed in the consulate here in Brazil.

    Thank you!

    I have the same question

I have similar case and wonder what to do next, I was in the U.S. Last summer on a J1 visa and recently found out about the two years requirement
I left the U.S. On August 2nd 2014, so the two years end in August 2016, should my girl friend wait until August 2016 to apply or can we start the process months earlier considering the fact that the application process will need few months! I knew from friends that we may start earlier and if the visa issued before August 2016 I'll have to wait until the two years end and I can travel. I have no problems o can wait but may be we can save time by applying earlier ?

    Thanks
