  • Need advice on what my status is (k1 visa/AOS)

    Hi there, I entered America on a k1 visa on 15th December 2014.
    Due to reasons I won't go into here I am not yet married and my visa/90 days expire on March 14th.

    Me and my fiancé do want to marry and intend on doing so ASAP but I fear we have left it too late to apply for adjustment of status.

    Currently I understand we need to get married and apply for AOS.
    What would happen if I were to be married but only have my application be accepted after the 90 days are up?
    If I am married and send off the AOS application before March 14th is this ok? even if the application isn't accepted before the 14th?

    what would my status be after I am married and the k1 90 day period expires?

    Apologies if I am not being very clear, starting to get pretty worried here!!

    Coffee,

    You have less than two weeks to marry to stay in compiance with your K1 visa. DO IT NOW!

    The Adustment of Status can follow at your convenience.

      Just to confirm, not having an application for AOS received before the 90 days are up is ok?
      I'm not going to be out of status or anything illegal?

        That is correct. You will be "out of status," and cannot work or reenter the U.S. after trips abroad, but will not be at risk of adverse adjudication.
