  • K1 case was approved by USCIS... but question about I-134 Affadavit of Support??

    Hi guys,

My fiance's case was approved by the USCIS and sent to the NVC. The NVC is now forwarding it to Beirut where he has to finish the remaining steps. But we're concerned about the I-134 form (Affadavit of Support). Both of us do not have high-paying jobs as of yet -- I'm a college grad student and work as a pharmacy technician part-time. He does after-school teaching in Lebanon and we each made about $7,400 last year. So almost $15,000 together.

Are we enough to meet the 100% poverty line? Would they deny him a visa if we don't make enough money together? Only form I-134 is requested at his interview, and it doesn't seem so extensive, but then when do we fill out the I-864? Can my mom be a co-sponsor? She made $33,000 last year but has 4 dependents. We're really confused about this part and want to be sure that his visa doesn't get rejected because of income.

Remember that you have to meet the federal poverty line for 2 people, not just one. For 2015 the federal poverty line for 2 is 15,930. It seems like you are below this. You may need to prove other sources of income or support. Does you live somewhere for free while you are working part time? (parents?)

A co-sponsor may help if they make enough, but remember that you have to provide all the documentation from their side proving their means to support you and willingness to do so.

If you are worried about the income, make sure you fill out the rest of the Affidavit including any money they may have in savings, any retirement savings, personal property of reasonable value, a home perhaps. Just remember you need backup documentation for all of these things.

Remember you need to prove to the interview officer that you are not going to become a ward of the state when you get here, or a welfare burden. Do everything you can to prove this. A Visa can be rejected for pretty much any reason. What is more likely is they will put your application on hold until you provide more proof of financial means. Of course that won't help you much if you can't actually convince them that you have the means.
