K3 Visa - Am I doing this right? Please and thank you!

  • K3 Visa - Am I doing this right? Please and thank you!

    Please ignore the title. It seems I was very misinformed about how to gain permanent residency in the US.

    So my story is that I'm a Canadian citizen married (less than a year) to an American citizen. We married in the US and my goal is to live in the US with him. I have been in the US for 4 months (cutting it close) on a traveler's visa at the time of this post. I thought my best bet was to apply for the K3 Visa but after going through more than 30 pages in the forums I see that it's not an option. If I am understanding this new information correctly because I'm in the States and married I just have to send in Form I-130 (Petition for Alien Relative), Form G-325A (Biographic Information), and Form I-485 (Application to Adjust Status)?


    Could someone help me by looking over what I am going to be sending in:

    -Form I-130 (Petition for Alien Relative) filled out by him
    -Form G-325A (Biographic Information) filled out by both of us
    -Form I-485 (Application to Adjust Status)
    -Form G-1145 (Electronic Notification)
    -Passport style photos of each of us
    -Copy of the marriage license
    -Copy of both our birth certificates
    -Affidavit from the Minister and our personal friend who married us
    -Proof of joint Master Card account
    -Document explaining how we met
    -******** wall posts and chat history proving that we meet 2+ years ago
    -Cheques for:
    * $420 (Form I-130)
    * $1070 (Form I-485)


    And that's all I have figured out at the moment. This is all a little overwhelming to me.

    I feel like I'm missing something VERY important. It would be a BIG help if someone point it out or confirm that it's all there.

    Thank you in advance to anyone who helps me. I'm very nervous about missing something and screwing this up.

    Don't bother wit the second step, for the K3 visa. USCIS is not actively processing K3 visas anymore They'll accept your K3 package, but nothing will happen.

    Do you want to be processed in the U.S. or in Canada?

    -Form I-129F (Petition for Alien Fiancée)
    -Copy of his(US) birth certificate

    -Affidavit from the Minister and our personal friend (again)
    -Biographic Information filled out by both of us (again)
    -Passport style photos of each of us (again)
    -Copy of the marriage license (again)
    (No fee with form I-129F because we filled form I-130???!!!)

    And that's all I have figured out at the moment. This is all a little overwhelming to me.

      I've edited my first post as I learned from reading your reply to another post that the K3 Visa is a thing of the past.

      My hope is to do all of this while in the States.

        If you want to remain in the U.S. while processing, you can submit the I-130 and I-485, with supporting documents and two fees ($420 and $1,070) at the same time.
