    Quick shout out to Ray B for helping me last time!


    Question: My husband and I filling out form I-129F and am stuck on Part 2, Question 1 (Identify the classification sought for your beneficiary). It lists K1 (fiance) and K3 (spouse) as the only two options.

    I understand that the K3 has been fazed out but I am not his fiance, I am his spouse, so K1 doesn't seem to fit.

    Which would I choose?

    You should be submitting for I-130 for a spouse. Applying for a K3 visa has to be done after the I-130 has been received and you have receipt proof, but is wasted effort. Don't bother submitting a K3 I-129F, unless you have postage money to give away.

    USCIS accepts K3 I-129F petitions, generates receipt and appoval notices, then puts the package on a shelf and proceeds with I-130 processing.

      I thought I had to submit form I-130 and I-129F...

      This is what I was going to send in all at once:
      Form I-130 (http://www.uscis.gov/i-130)
      Form G-325A (http://www.uscis.gov/g-325a)
      Form I-129F (http://www.uscis.gov/i-129f)
      Form I-485 (http://www.uscis.gov/i-485)

      So I should take form I-129F off that list?

        You have your steps out of sync.

        If your wife is outside the U.S., you submit an I-130, G-325A for each, $420 fee and supporting documents to USCIS.

        If your wife is in the U.S. on a valid visa, you can convert his status with I-130 and i-485 submitted at same time (with G-325A for each and supporting documents). Fees will be $420 and $1,070.

        Forget about the I-129F. You're looking at instructions which no longer have relevance.
