Here is my situation. I am dating a woman from the Philippines who has a son and I want to eventually bring both of them here on a K1 visa. My plan is to go visit her in September for 3 weeks (or more) then if everything goes well file for the K1 visa in January.
Now here is my financial situation. I was laid off a month ago and I am collecting unemployment currently. I earned about $11,000 so far from my previous job ths year. I now have a decision to make. It wouldn't be very difficult for me to find a good paying job in the field I am in and easily exceed the $25,000 requirement. The only problem is if I do I might not be able to take a trip to the Philippines in September and might have to wait until January (depending on how much my future employer is willing to work with me). My other option is I can take a lesser paying job for now that is more flexable so I can go to the Philippines in September then come back and get a higher paying job. The only problem if I do that is I will risk not meeting the $25,000 requirement for the year.
What I am wondering here is if I can demonstrate I have a good paying job at the time of the visa interview and the projected yearly income is above $25,000 will I be okay? I should have a job well before January and will be able to demonstrate a stable income for several months by the time of the interview. Also If my unemployment is counted towards my income for this year I should still hit $25,000. I guess what I am asking is if my last 3 years of tax returns show below $25,000 but I can show I have a steady job that will earn me over $25,000 will that be good enough? If all I provide are pay stubs and an employer letter with my I-134 and no tax returns will it be accepted? I am confused here as I have been told different things by different people. I can earn over $25,000 for this year if I have to but I am going to have to make some decisions very soon here. By the way a co sponsor is probably not an option.
