  • Just got my decree absolute: Can My US citizen fiance file for petition right away

    I have been separated for 3 years and recently got decree absolute after a protracted period of divorce . Meanwhile I have dated my US fiancé for 2 years and we are now in the process of filing for the k1 visa petition. My decree absolute just got granted and I'm now free to marry, hence filing for the petition. Will this me an issue during visa interview stage as I was engaged to her before the divorce was finalised?

    The American consular officers are familiar with long, protracted divorces. They understand that these things happen.

    They will be more concerned about the bona fides of your current relationship.

        All fiancee petitions are heavily scrutinized. Every applicant is treated as a potential marriage fraud case. It is up to you to persuade them otherwise. I do not believe that your circumstance warrants extraordinary scrutiny, but the ordinary level of scrutiny is plenty invasive as it is!

        The attitudes of consular officers are shaped by their experience with visa applications. The United Kingdom has historically lower levels of visa fraud. Make sure you can document your relationship well, and try not to lose sleep over it.

          Thanks. We have contracted a law firm just to make sure that all documents are properly filed while following the correct procedure. In documenting the relationship, apart from the obvious,(eg evidence of visits, photos, phone logs, emails etc.) is there any additional evidence that could help to present a good case and interview?
