Apply for Fiance Visa during waiting period after divorce?

My boyfriend's divorce will soon be finalized, but in the state where he lives there is a waiting period of 6 months before you are allowed to remarry. Is it possible or not to apply for a Fiance Visa as soon as his divorce is finalized or do we have to wait until after the waiting period is over as well?
