I am totally lost / finacee or spouse ?

  • I am totally lost / finacee or spouse ?

    I have B2 visa vaild till 2023. I have entered to country for 3 times so far and I had no problem.
    We were going to marry in our own country on her last visit but many people told it takes too long time to receive documents ( up to 1,5 years)..
    But now I decided to go by fiance or spouse visa.
    which is the best and quicker way ?
    To go for a temporal time to visit her again like I do every 6 months, and get marry within one week and go back to my country ? in this case can my fiance can apply for spouse visa ? Is a proper way since I go back to my country ?
    Or is it better if she directly starts from there to apply for me fiance visa ?

    how is the differences of process and sponsorship income requirement ? I check proccesing time web site but I could not understand really how it works.
    Also how much does she need to show for sponsorship. She just decided to change her job ant taking it slow to find a new one. Will she need to show a regular income right in the first documents ?

    Besides, will I be allowed to keep travelling to us while this process goes on ?

    I would also appreciate if some one can tell any other faster way except going and doing it with B2 visa which is unnecessarily risky ?

    *edit, also how would be I go to states get marry, right after applying a spouse visa and If I keep staying in Usa by going to some course about my career field ? the problem is we don't want to do it long distance 1 more year..

    My suggestion why don't you come here and get married and do an Adjustment Of Status I think that would be easier by far....

        Hello horus. I'm pretty sure I'm understanding your English well enough and the answer is Fiancé visa! There are extreme delays right now with the national visa center processing 3 times the amount of immigrant visas. They are only allowed by law to process so many at a time so there is a wait list delaying some unfortunate folks 2+ years. Fiancé visas however are not truly immigrant visas because they are only valid for 90 days to get married. Then you will apply to change your visa status to immigrant which will take forever but you should be allowed to remain with your fiance while you wait. I'm not certain though if you are permitted to leave and re-enter the country after marriage while you wait for your visa change so you may want to wait until you are ready to come and stay. If you do happen to visit the country for a legitimate reason which pertains to your current visa and you and your fiance decide to get married while you're here for a legitimate reason that is perfectly legal, but be prepared to prove that you were here for a legitimate visa reason and that you did not come with the intention of getting married. And again, after marriage there may be issues if you need to leave the country while waiting for your immigrant visa adjustment, you may not be able to re-enter until it's complete. Hope I was off assistance. I'm not a lawyer, im just a guy waiting for my fiance to get here with alot of free time and Google. :-)

          Forgot, your fiance's income doesn't have to be alot. It just has to be over the national poverty level which I think is 27,000 a year. If they do not make that much someone else who does make over 27,000 can actually be the petitioner for you to come and marry your fiance. I don't know any more about it though as i didn't need to go that route. Good luck
