    Hello!
    My US Citizen Fiance just got a job offer. He is moving to California in August to start his job. We are planning to put through the K1 visa.

    Now, he had been an international student who didn't work for the previous 5 years, thus he didn't have to file any taxes in the USA.

    His income at his new job is far above the requirements and it's a full-time permanent position.

    Will this cause any issues with the Affidavit of Support?

    Will we need to wait some time until he has some paystubs?

    He should be able to get a letter from his employer's HR department stating his job position as well as his annual salary. That should help.

      To semi answer my own question in case anyone else is in a similar situation:

      From the USCIS site:

      Affidavit of Support For Fiancé(e), Spouse, or Child as a “K” Nonimmigrant
      If your relative is either a “K-1” fiancé(e), a “K-3” spouse, or a “K-2” or “K-4” child of fiancé(e) or spouse, you do not need to submit an affidavit of support at the time you file your Form I-129F petition. Instead, you should submit an affidavit of support at the time that your fiancé(e), spouse, or child adjusts status to permanent resident after coming to the United States.


      This means that he should be working for a couple months until we need to file my AOS, where we include the Affidavit of Support, which will allow him to get some pay stubs, pad up his bank account, and show that he has a full time permanent job.

        Employment required for Petiton or visa ?

        Hello everyone i have a question soon my fiance is applying for a petition but we are stuck from last 2 months because she is unemployed currently would that affect our case ? i really need help of you guys i am living in the UK and my fiance lives in US , can we apply for petition if she doesnt have any work if its on me i am working here and i have a bank balance too which i can show at interview ,

          Get a job letter from employer

          I was in a similar situation. I had just began my full-time job when I filed my fiancee's I-129F. So I didn't have a full year's salary on the taxes (it looked like it was below poverty). So I wrote a cover letter explaining it to the USCIS and also had a "job letter" from my company to prove that I had a full time job making xx salary. I included lots of paystubs to prove it. That was accepted by USCIS.
