  • Leaving the country before AOS.

So, my husband entered the USA on a K-1 visa. We are now legally married, and about to start the Adjustment of Status process. Our wedding party is in September, and cannot be missed/postponed etc.

Here's the problem: He URGENTLY needs to return to his home country of Ireland - within weeks, possibly within days. We *do not* have time to wait on Advance Parole. He needs to get there ASAP.

He's a dual citizen with the UK, and has two passports.

    What can we do?

If he leaves before having the Advance Parole, he will have abandoned his Adjustment procedure when he is unable to reenter the U.S.

DONT DO IT !!! His case will be considered as abounded and he will need to apply for K3 OR CR1 option. I did that before i got the advance parole because i wanted to attend my grandpa's funural and now im stuck in my country for a whole year and no news yet. Take an info pass and apply for emergency travel.
