  • Petition for fiancé while living abroad HELP

    I am a U.S. citizen born there but live in Peru and have lived here most of my life. I've visited the U.S. 4 times with no problems. I want to go to the U.S. to marry and live with my fiancé. I am aware that I have to file for the petition in the U.S. But, my questions are; Do I have to reside there? Do I have to be living there for a certain amount of time to ask for my fiancé? And once I file the petition, can I travel back to Peru while I wait for the answer? Or do i have to stay in the U.S.? And if so, can my fiancé stay with me on a Visitors/tourist Visa? (He already has one)

    There are several answers to your questions:

    1. You should have a U.S. address at which you can receive immigration-related mail.
    2. You should plan o having proof that you mantain a U.S. domicile or will reestablish a domicle before or at same time your fiance comes to the U.s.
    3. You might also consider having your fiance come to the U.S., marry there and process his Adjustment of Status in the U.S. without him returning to Peru.

      I am in a similar situation. I am a US citizen but have lived in my fiance's country for the last three years. I had planned to go back to the US to file the paperwork and use my parent's permanent address until I move back early next year. How can I show prove that I will permanently move back to the US myself? Like a sworn affidavit that I would submit with the application? Or it is better to not submit that stuff unless they specifically ask for evidence?

      I read on one of the US embassy websites that they strongly do not recommend foreigners to enter on tourist visas while their K1 visa is in process because the immigration official at the airport might think s/he is coming in to get married before it's approved and then they would deny entry.
