  • Marrying on a B1/B2 visa in order to finish a course in my home country

    Hey there!

I'm a Brazilian citizen who was very happy to hear about the same-sex marriages being now official in my fiancée's state of residency (Texas). My question is... I have a post-graduation course I'm currently taking part on and which will go until October, 2016. We have talked about getting a fiancée visa, but that would force me to head to the US to stay there and get married within 90 days, which would mean I'd have to interrupt the course I've already paid for.

The question is... I do have a B1/B2 visa valid for 10 years, and I'm going to the US at least twice a year (seeing her for at least once of those visits, although we don't really like pictures and are really discreet in what we do or say due to family issues to same-sex relationships). Would it be ok for me to go there to marry her, and then return to finish my course while she applies for a Spouse visa? Then it would be good timing for me to finish my course before packing up my bags and moving with her.

That said, are chat-logs a good indication of a 'proof of bonafide' marriage in case we are asked that during the permanent residency process? Considering how we really don't (cannot) open our relationship to family and only a few friends know about it, we have been wondering about how much they actually consider as proof.

    Thanks in advance!
