  • Marry a LPR (legal permanent resident)

    Hi there,

Within nine months I want to marry my fiancée who is a permanent resident (LPR) in the USA (and no US-citizen, otherwise it was easier I guess). We want to marry in the USA and I want to live there immediately afterwards and I want to get a work permit then asap. At the moment I am living in the Netherlands. Initially I thought to come to America with an I-94-W, that's a green visa waiver, but probably that's not a good idea.

    My questions are:

    (1) Am I eligible for any fiancé-visa? or
Do I need any B-visa? or
Can I just come in with the visa-waiver and apply for a V-visa, because I am her spouse then, after deposing the marrial papers?

    (2) How can I get a working permit or green card?

Thanks in advance for your help!

    Eric

    1.
Fiance Visa: Available only to fiancees of US citizens.
Visitor Visa (or I-94w): You will have to wait several years before you can file I-485. Until that, you can't be on visitor visa as visitor visa is maximum 1 year and I-94w maximum 3 years.
V Visa: You can't do that either. Read https://www.immihelp.com/usa-visas/vvisa/index.html

You can't do any of that.

    2. Wait in your country for few years.
