k1 VISA while fiancee in USA

My fiancee in USA on B1 visa. He came to attend interviews. applied for B1 extension 3 months ago, but the result is still awaited. He asked extension till Feb 10th 2006. I have 2 questions
1. Can I file I-129F while he is in USA? Does it affect him in any ways?
2. Can he stay after Feb 10th if his visa extension application is pending, eventhough he asked for extension till Feb 10th?
