  • Is it possible to apply for a spouse visa at the same time as H1-B visa?

    Hello

I am new to this board, but have found many very usefull discussions and suggestions here.

However, what I have not been able to find is answer to the following scenario which I am in.

Let me start with a little background:

I have been in the US for the past 2 years working as an intern for a US company. The company applied for H1-B in April 2015, but I did not get selected in the lottery. I moved back to Denmark after my J1 visa expired in August. I am currently continuing to work for the US company from their European office here in Denmark. The plan is that the company will try to apply for H1-B again in 2016 and if that fails, they will after I have been working from Denmark 1 year, they will apply for L1 Visa (which is all good)!
I have a girlfriend who is US Citizen. We have been together about a year, and have lived together for about 7 months before I had to leave the country. I am 29 years old and my girlfriend is 36.

We are seriously considering to get married and start the Spouse Visa application as we miss each other too much!

Is it possible to have my (potential) wife apply for the spouse visa and then in April 2016 the company I work for will apply for H1-B?
Does this approach limit chances of getting either of the visas?

    Kind regards,
    DK-Viking

can someone please suggest the best way......

    hello,To all respected members,
i would like to start from the beginning so its easy for you to understand my situation.
i am originally from mumbai, india and i have been working in usa for last few years with one of the performing and arts company on P-3 visa.i do have my social security card and driving license also.i typically used to get one year visa but my employer used to file an extension so i can work further continuing while working in usa.right now i am back to india, since i have finished my contract. and i am not willing to go back for the same job.my visa I-94 petition is valid till 27th oct 2015 from my employer.
now my main concern is,since i am in mumbai. i have put my personal profile online on matrimonial site for marriage purpose and i got thru with my desired partner by grace of god.she is a usa citizen, working in usa since 2012 as software consultant in reputed company and filed for the green card as well. and originally she is from same country and same city.india/mumbai.
since we both like each other and really want to meet her personally and take this relationship further very positively and wants to get married if everything goes well.she is doing really great in her job.and also we both are planning to get settled in usa and see our future and career here itself.we both genuienly wants to get married in a good faith and pursue our life in usa.
there are several different posting on web site but its little confusing to understand since everyone has a different situations...
i would request if you can please help me out step by step what should be my moves towards all these process? should i apply for tourist visa and go to usa meet her and get married and stay there itself or do i have to come back to india?
i dont have any relatives or family there in usa.so should i ask any of my friend or coullague from usa to send me invitation letter for my tourist visa?
or according to you which visa i should apply for being complete safe and sound.
i am not targeting to do any kind of visa fraud or any illegal things.....i simply want everything should be done in a very correct and good manner so we can get married and i can apply for necessary visa status and work there.
its a request if you can please advice me the correct way, rite now i am in mumbai and really waiting to take this process ahead without any delay.
i will be really glad to hear from you.i would request if you can please take this matter under consideration and advice me for the same.waiting for reply.thank you
