Need help with I-129F and I-130 approved by USCIS at the same time

  • Need help with I-129F and I-130 approved by USCIS at the same time

    I filed an I-130 petition for my wife in Vietnam and I-129F for the K3 visa. on Sep 15, both I-129F and I-130 were approved at the same day. I have done some research on the internet and found out that the I-129F will be closed if NVC receive the I-129F. My situation is that even though both petitions were approve at the same time by USCIS. NVC only received the I-129F at this time. it's been almost 8 weeks since USCIS approved my petitions. and the USCIS also said (i called) that the have sent both to NVC. but now at this moment NVC hasn't received my I-130 yet. but they have already sent the I-129F to the US consulate in Vietnam. Me and my wife wanna go with the I-130. are there any problem with my I-130? why does it take so long to get to NVC. should I do anything or just wait for the I-130 to get to NVC (which God knows when), any advice will help. anyone with the same situation please share your knowledge. thanks much

    It's very unusual for K3 petitions to be forwarded to the NVC when I-130's are approved at the same time. My advice is to go with the first procedure that is available to you, since the apparent delay with yur I-130 suggests a possible problem with it.

        Doesn't having a I-130 approved automatically void the I-129f? Or would you have a choice to withdraw one of the petitions? seems kind of confusing here.

            The K3 I-129F and I-130 do not contradict each other. The I-130 usually moves forward and the K3 I-129F just sits in the U.S. and nothing happens to it.
