  • FIANCE VISA QUESTION: Poverty Guidelines

    Poverty Guidelines Fiancé Visa?
Hello, I would really appreciate it if someone can help me clear my mind by clarifying what the Poverty Guidelines for 2015 really means.

I am currently working in an Office as a Biller since August 2015 (just recently, but had jobs prior, since 2013) and I am getting paid $13 per hour. Which, if calculated, would give me $21,840 if I work a full year (but only $16,000-$17,000 after taxes)

I am filling for my Fiancé s visa (he s in the Philippines) and I was looking through the 2015 Poverty Guidelines. It says that the sponsor needs to make $19,900+ for the year otherwise I would need a sponsor (I have no one but myself).

Questions: (1) Is the Poverty Guideline talking about the whole amount I earned a year? Or is talking about the amount after taxes/medicare were deducted?

    (2) Will our application get approved considering that I ve only had my new job for 10 months when the time comes for the application of my Fiancé s visa?

    PLEASE HELP

Your gross (W2) income is what counts. You need $19,912 annualized income (Poverty Level + 25%). Your $13 per hour becomes $27,000.

you need 100% now but you will need 125% in the future

To petition your fiance you're going to need to meet 100% of the poverty limits. But most people would advise you to meet 125% because later on, you're going to need that for the Adjustment of Status. In fact, the consulate might even require that you meet 125% since you're they know that the adjustment of status is not too far away.

It seems like you're in the borderline. Do you think you can get a joint sponsor?
      --Good luck--
Good luck. I learned the hard way, I hope you don't have to. Immigration is interesting. Not considered as legal advice.
