I am a US citizen and my girlfriend is a Canadian citizen. We met at school in the states and have been dating 5 years. After she graduated she moved back to Canada and now I am looking to get her to the US.

1- I currently don't have a job since i left to visit her in Canada for 3 months, do i need a job to apply for the K-1 Visa?

2- Do we need to be engaged to apply for K-1 visa? We are currently dating and not engaged

3- Would it be better or faster for her to come visit and get married and return to Canada and then apply for a green card?

4- Could she come to the states on a student visa for grad school and then get married and apply for a green card?

1. Even though if you don't have job now, you need to have some assets and it's above the poverty line.
2. Yes. It's called Fiance visa.
3. Sometime problematic.
4. Her intention is to get marry and filed gc. Not advisable.

1. you technically don't need a job. You need to show enough assets/income to be able to financially support your fiance(e).
2. You don't have to be engaged. Even though it's called a fiance(e) visa, the only requirement is that you have physically met in the last 2 years and also intend to get married.
3, 4. Don't risk it. Because you might be labeled under "visa fraud" for misusing a student/visitor visa. Be careful!
