I am a 21 year old college student, graduating in May. I am the US citizen trying to bring my fiance in to the country. Concering my ability to provide for him, I have held a part time job my entire college career, but I know that I do not qualify for the "above poverty level" requirement for the K1 visa. Are there no exceptions to this requirement for situations such as these? Obviously this won't be a problem once I start my career, but as of now, I do not qualify.

according to the info provided by this site.. you can have somebody else sponsor your fiance. check the I-134 info...

I am in the same situation (student with part time job but not enough money to meet the req). In this case you get a cosponsor, (mine for instance, is my mom). The cosponsor must prove that she can support herself, and everyone who is dependent on her income as well as your fiancee, above the 125% poverty guidelines. You and the cosponsor then submit the I-134 when your fiance goes for the interview.

Hi,If you are trying to or are thinking about applying for a K-1 Fience Visa a co-sponsor will not be accepted by the immigration officer at the interview.They will accept a co-sponsor when applying for a K-3 spousal Visa,meaning you will have to go to your fience's home country and get married there and then return to the U.S. and start the paperwork.The process can take anywhere from 1 year to 18 months providing all goes well.The reason I know this is because I was told this by 2 different attorneys and also my fiencee and I went to the U.S. embassy in the Philippines about 6 weeks ago for my Legal capacity to marry form and decided to ask a immigration officer this same question.I also dont meet the guidelines because of a layoff and we wanted to be sure that it wasnt possible for her to get a K-1 Fiencee Visa.I wanted to hear it right from the horses mouth "so to speak".So after waiting in another line for about 2 hours we were able to talk to a immigration officer.He confirmed what I was told from the attorney's-they will not accept a co-sponsor when applying for a K-1 Fience Visa,he said you can use a co-sponsor when applying for a K-3 spousal Visa.Now this is info i got at the U.S. embassy in the Philippines,but I am sure the same thing is going to apply no matter what country your Fience is from.To be sure yourself maybe contact a immigration attorney that has experience in K-1 and K-3 visas for the country your loved one is from and ask them about this situation.You may have to pay a small fee to talk to them but its probably worth it just to hear it yourself.Good Luck-Gary

I was just reading JLN7124's reply to your question.Thats got me scratchin my head.He said he was in the same situation and he used a co-sponsor .I am really curious to hear about his outcome from the interview.If the interview hasnt taken place yet I would like to find out where he learned that this would be acceptable at the interview.Remember! When reading about the rules for sponsors and co-sponsors it may say that you can use a co-sponsor when your income does not meet the guidelines but bottom line is-Its up to the immigration officer whether or not he/she approves the visa.I was told that they (the immigration officers) are not accepting co-sponsors for a K-1 Visa.This isnt written in Black and White anywhere.It is a unwritten guideline that all the officers are following.So if your reading this JLN7124 please tell us the outcome of your interview and/or where you learned that you could use a co-sponsor for a fience Visa.Because if for some reason the attorneys were wrong,the immigration officer at the U.S. Embassy was wrong I would like to know because that would mean that I could get my Fiencee here alot sooner because we havent married yet.That would be the greatest thing in the world to me.I was also told by a very reputable attorney-his exact words were-"DONT EVEN TRY USING A CO-SPONSOR FOR A K-1 FIENCE VISA" But if there's someone who recently got a K-1 visa using a co-sponsor, PLEASE RESPOND!!!!!
