Fiance has 10 year multi-entry Visa from Philippines, should I still file Fiance Visa

  • Fiance has 10 year multi-entry Visa from Philippines, should I still file Fiance Visa

    Hi! I'd like to know the advantages/disadvantages of filing a Fiance Visa vs Tourist Visa then marry here.

    She's from the Philippines and already has a 10 year multi-entry Visa. There's probably a few advantages for filing a Fiance Visa vs going the Tourist Visa route.

      Fiance visa works better than tourist visa. When she comes on tourist visa her duration of stay depends on I-94 stamp. Fiance visa is more secure and she doesn't need to leave US.

        Actually, if she enters on a visitor visa and later decides to marry here, her I-94 expiration date will not be an issue. She can then be petitioned and Adjusted at the same time without leaving the U.S. (so long as the petitioner is a U.S. citizen)

            Perhaps the "other poster" is exaggerating the seriousness of using a visitor visa to convert status.

              Here's the full context of it.. I think what he means is if she's traveling here with intent on marrying and staying, then that's fraud, but if she flies back, it's ok.
