How avoid the 864

I may be the only one who thinks this, but the 864 is a dangerously one-sided document. Everything is dumped on the sponsor and now I'm told it could be used to hammer a lifetime of insane alimony payments.

With that said, I've been in constant contact now with someone for a few years, we have not married yet, but am wondering how to approach. Marry there or marry here on K-1. I do not want to sign the 864. Nothing to do with her now, but to do with reality.

After reading it and talking it over with my attorney it seems our wonderful government is jumping into our bed and essentially going to scuttle any chance of us getting married and living a life here in the USA.

So is there any way a sponsor can marry an immigrant and bring her to the USA without the 864 hanging over the sponsor's head??? Thank you.

Short answer - no!

If you are the sponsor (or even a co-sponsor) for bringing an immigrant to our country, then you are financially responsible for them (for some time). Whether fiance visa or even spousal, it's your burden to make sure you can provide for them.

Now the case is that if there's a divorce, then the sponsor (and even co-sponsor) are responsible for alimony if the court finds it necessary!

You're right, it's a dangerous piece of one-sided legal document. It's forces you to be very confident that the person you're sponsoring is not going to screw you later.

The legal requirements of the 864 cease if the immigrant himself/herself works and is able to earn an income, or if/when they become a citizen of the US.

sucks, I know. I unfortunately had to bear some brunt of this.
