My fiancee is a citizen of Netherlands. He is currently in the U.S. (entered on a 90-day WT visa waiver). We are planning to get married in Texas in July 2016. He will then leave the U.S. and go back to the Netherlands before the expiration date of his WT status.
I will then file an I-130 followed by receipt of I-797 and filing of I-129F to get him the K-3 visa and allow him to return back to the U.S.
Question #1: can I file I-130 while he is still here on a WT status? Will it look bad? We are well aware that WT status is not "adjustable."
Question #2: does anyone know current processing time for I-797 and I-129F? I am a resident of Texas.
