  • fiance's son ??

I am a citizen born in the USA and am engaged to a Bolivian lady. Her son is nearly 18 yrs old and of course she will want to bring him with her to USA. I looked on the Immig/Natur website and it said that any child under the age of 21 can be brought to the USA with their mom when she marries a citizen born in USA. A Bolivian lawyer told my fiancé that the child must be under the age of 18 to come with his mom.
Does anybody know the real answer to this question...thank you in advance.

The Bolivian lawyer has his head in the ground. Your first suggestion (under age 21) is correct. A fiancee visa holder can bring any children under age 21 with her on dependent K2 visas.
