We are looking to move (back for her) to America. When we do we will have been married for over 2 years and I want to check I (UK citizen) have my facts correct:
My wife files I-130
I file K-3 once we get the I-797C
My slight confusion is that I understand if we've been married for over 2 years that on arrival I'll automatically get a green card and won't need to apply for a change of status, do I get that at immigration when we first arrive and should we plan for a longer than normal arrival process? I'm assuming if this is the case it means I can then look for work, apply for an SSN etc. immediately or is there some processing time I'd need to wait for.
Also due to my work with a startup we may get the K-3 approved but not be ready to move as a family (1 child currently) for a few months, is there any form of time limit once I have the visa before we need to travel to the US? I'm wondering if it's worth applying for everything well in advance knowing we will be married over 2 years by the time we travel or whether I should wait until we've been married for 2 years before I start the process?
Apart from the complexity of the forms and various bits needed for the K-3, given our relatively uncomplicated situation (financially stable, no criminal record or health issues), is there any real need to hire a lawyer, wondering what people recommend?
