i am now starting the process of the k-1 visa but what if my fiancee is in the us illegally is it better to marry here then file for his papers to stay in the us or is there a penalty...should he go back to mexico and then i should file the k1 im confused

if she is in the us with u , u cannot file for a K1 visa, that is just if she is not in the us and u want to bring her ther. if she is there u can marry her and then file for a K3. u should talk to a lawyer before fileing any document because an immigration lawyer can tell u specific solutions for ur situation aqnd more accurate ones.
