I am currently engaged to my fiance who I have been in a relationship with since Jan 2015. We were engaged on my 31st birthday in October. I am not sure which immigration process is best for applying for his residency/expedited naturalization. Here are my facts:
I am a US-born citizen that has lived her whole life in Maryland, went to school paid taxes up until Sep 2014, when I moved to Ecuador to live abroad. I have a 12 year old US-born citizen son that also moved with me.
When I was 16, I studied abroad in Quito, Ecuador for a year in a school called Bauhaus, and I finished 11th grade. In that school I had a classmate, P that was my friend. We did not date then, but we were friends.
Fast forward to Oct 2013, P and I reconnect on ******** thru other friends from Bauhaus.
In Sept 2014, my son and I move to Quito, Ecuador where he attends school and I start to work. We are both Ecuadorian citizens because we have double nationality (given thru my parents!)
In December 2014, there is a reunion of our classmates from Bauhaus and P and I see each other after so many years. We are both single and we start a friendship that turns into a relationship. I am very ********/instagram active so I post a lot about our outings and vacations.
I start working at IOM Ecuador for the PRM Refugee program of resettlement to the U.S in May 2015. IOM belongs as of Sep 19th this year, to the United Nations. I have a contract which has no definite end date. Therefore after reading the requirements for expedited naturalization, my spouse would qualify.
In Jan 2015, my fiance (When he was only my boyfriend) applied for a TOURIST VISA, was approved without any issue and we vacationed in the US for one month, we travelled to Miami, DC, NY, Los Angeles, Las Vegas, Columbus OH, and Chicago. No issues with immigration.
In Aug 2015, we travelled to El Salvador and Guatemala. In Aug 2015, my 12 year old son decided he no longer wanted to live abroad in Quito anymore and decided to stay in Maryland with my mother to go to school there.
In Oct 2015, my fiance proposes in the beautiful beach of Manabi. And we are ready for the steps needed to be able to have a family together in the US one day. At this time, I am still in Quito working for the UN. He is also currently under contract with the same organization as an Ecuadorian. Therefore, I would like an expert's opinion if I should opt for the fiance visa K-1, and send this for processing in Dec (I am going home for Christmas) and wait until we are approved for us to go to the us and get married in Maryland. Or do we get married here in Ecuador, and send the I-130 peition for processing in Dec- in order to wait for the LPR and than apply for expedited naturalization as soon as my husband would be approved for his LPR? I am concerned about wait times and processing and we do not want to hire a lawyer. In the end, we will live in the U.S once the contract i have ends, which is not for a while but we do want to raise our future children in Maryland. Please advise anyone that has knowledge on this.
