    Hey all,

    I and my girlfriend are considering applying for either the K1 or K3 visa. She's currently a student, but has an income of around 16k. I understand that that's probably enough for the K1 but not the green card affidavit of support. So here's my question: Do immigration officers look down on and have a high chance of rejecting applicants who have a sponsor and a co-sponsor as in my case? Especially if the sponsor is still a student? What are the chances that the application would get rejected, even if the co-sponsor earns much more than the 150% poverty line?

    Also, I read somewhere on here that the K3 is pretty much obsolete now. Is that true?

    K-3 is obsolete. You would get the immigrant visa directly.

    I-134 which is used for nonimmigrant visas like K-1 is not legally binding. As such, some consulates do not accept "co-sponsors".

      I 134 is decided at Consulate level and varies between Consulates as to how they deal with it.

      If you marry and go the CR1 route then yu use the I 864 which is 125% and you would need a joint sponsor for. You will need the I 864 on a K1 when seeking adjustment.

        Sorry, I guess I meant joint sponsor, not cosponsor.

        When I apply for adjustment of status, should I tell them that I already have a social security number? Or would they know that? I used to work under the OPT.

          You will fill your SSN on all forms that ask for it.
