Hi, I used to be a green card holder, along with my wife. She took U.S. citizenship and I did not do it, yes, my mistake. We got divorced, and I went back to India, with every intention of me coming back. I overstayed and my green card got expired too.
However, when I applied for a Returning Resident visa (ssb-1), i was refused by the Mumbai Consulate.
Couple of months later, I fell in love with a U.S. Citizen girl, and we met, and we have now decided to get married. We are ready to move and file the I-129 petition.
Now, my questions are:
1. Will I face any issues?
2. Me having been refused my SSB-1 before, will it affect my chances?
3. Can my ex-wife prevent me from getting a visa, in any way?
4. What are the things that I should be careful about?
Any guidance/replies will be deeply appreciated.
