  • J1 during K1, ESTA, etc.

    A few questions regarding marriage.

First question: Is it possible that someone who got a job offer (J1 visa from August 2018) get married before August 2018 to his girlfriend (a US citizen), when he comes with an ESTA to the US and would fly back to his homecountry after the wedding and would come back after a few days/weeks for the job (with J1 visa)?

Second question: Would it be possible to start the I-130 and Green Card process during the job (J1 visa) from the US?

Third question: If the couple applies for the fiancé visa, is it still possible to apply in this process for the J1 visa, which is necessary for the job?

    Thank you!

If your J-1 has the 2-year home residency requirement, you should not use it because it will prevent you from immigrating until you've been in your home country for 2 years.

I really don't understand why you are dealing with J-1 when you are immigrating (i.e. becoming a permanent resident).

This is my personal opinion and is not to be construed as legal advice.
