  • Had to Cancel my i129F prematurly.. am i black listed?

    HI, I had mailed off my K1 i129F visa package 2 weeks ago but had to immediately cancel it due to unforeseen issues. My fiancé and I still want to get married, but will hold things off for awhile. The problem is not only did I send a letter to withdraw the visa right when I received the notification it was received, but I also put a hold on my account so the funds would not be pulled. Will this incident hurt me for applying for the visa a few months down the line? if so, what can I do to mitigate this situation? Completely understand this was my irresponsibility, I appreciate any advice given. Thank you.

      If you're wondering if you need to obtain a Multiple Filer Waiver under IMBRA, no, you're not black listed yet

      An IMBRA multiple filer is a US citizen who previously filed two alien fiancee petitions, or had one alien fiancee petition approved within the last two years

      In your case, you have only previously filed one alien fiancee petition, and it was never approved


      If you're wondering if your previous filing will affect complicate or frustrate your new filing, the answer is probably yes. It will raise further inquiry into your and your fiancee's situation. Immigration petitions are serious business, don't treat the process frivolously again

        You put a "stop payment" on the check you submitted with your petition package. That was a mistake, because once the petition package is accepted by DHS, you owe them $535. If your check is not honored by your bank, you will be billed by DHS or the Treasury Department, and the fee amount, with any penalties, has to be paid to DHS or it goes into collection mode.

        As posted by "inadmissible," immigration procedures are serious business, and your cancellation and stop payment actions are viewed as frivilous.
