  • K-1 vs B-2

    Hello,

I would like to ask what the advantage to the K-1 visa is over the B-2? And, can a B-2 change to a K-1 while the visitor is here? Does anyone have any experience with this kind of situation? Thanks, your input is appreciated...

The purpose of K-1 is to allow someone outside the US to enter the US to marry a US citizen in the US and file Adjustment of Status. If you are already in the US, you can already marry in the US and file Adjustment of Status. You cannot (and don't need to) "change into K-1". If you are outside the US, you are not supposed to enter on an B-2 visa, or most other types of nonimmigrant visas (with the exception of H and L work visas) with intent to file Adjustment of Status during that stay; that's why you would get a K-1 visa.

This is my personal opinion and is not to be construed as legal advice.
