My fiance has a tourist visa and is currently in the USA. We want to start the K-1/K-3 process but am not certain about whether she can be here during this time.
Want to do all properly, not violate any laws or procedures but have read that if a K-1/K-3 candidate has a tourist visa that they could possibly be allowed into the country and would be turned away under the premise that the official may believe there is no intent to leave.
Her time she can spend on this trip is until 11/29 but currently has a return flight scheduled for 09/02/18. Let's say she does return 09/02 and the immigration process has begun will she be allowed to re-enter after a few months? If she can be here during the application and approval process could I extend her return flight from 09/02 until 11/28?
Just want to follow the proper procedure and not jeopardize any future ruling.
