Indian on B1 Visa to Be Married to a US Citizen - Can We Get Married in a US Court?

    Hello Forum Members,

    I have a query regarding my due marriage to a US Citizen. I am an Indian citizen holding a Tourist Visa (B1/B2) for ten year multiple entry into the United States. My fiance is a US citizen based in California. We are due to get married in March 2019. I have two options -

    One is for me to go to USA on tourist Visa and get married in a US Court
    Other is for him to come to India, get married in India and then we both go to US.

    I want to file for my green card after the marriage. Is it permitted if I marry my fiance in USA when I am present in the country on a tourist visa? We think that it would save the time & hassle of covering legal formalities in two countries. Which option do you suggest?

    Either one is okay. Intending to marry and then leave is perfectly fine on a tourist visa. You just can't have preconceived intent to marry and then stay and do Adjustment of Status in the US. You might still be denied entry though, if they don't believe you.
