HI and thanks for this great forum.

I am an american citizen. My fiance is Italian.I am headed to italy to marry him in late July.

I will stay there for two months and will have residency there, and travel back and forth a bit for the time that we are waiting for him to come to the states legally.

    questions

    1. can I file any papers before leaving the states to help along his application?
    2. do I file I-130 once we are married via direct consular filing there, then the I-129?

    3. is the k-3 visa the way to go, fast, etc, etc.
    4. Is it possible to file k-1 before I go, then while it is pending, get married?
or does this just muck up the process?

    5. Any info on Direct consular filing in Italy?

    Thanks very much.

    1. You cant file a I-130 unless youre married already

    2. You best bet is to marry then file the I-130 and then apply for K-3. Though there is nothing precluding the filing of the I-130and I-129 simulatneously, becasue youll need to prov ethat an I-130 has been submitted , you should file that and then wait for the receipt notice which you have to attach to the I-129 petition. I think you should file with the USCIS regional office , which you can do although you're overseas, but perhaps someone else can advise on consualr processing
