    This is my opinion:
    I have been hearing some bad things about I-129, because the rate of rejecting is higher now (especially in VN). Plus, when the spouse gets to America, it takes forever to get a green card nowaday.
    I'm sticking w/ spouse visa ...

      I too went for an inteview for a tourist visa so i could spend longer than the 90 day visa waiver program. I was also denied a non-immigrant visa to spend time in the states with my husband on a temporary basis to help him file all the forms necessary for immigration. Because your girlfriend is intending to move to the states permanently she doesnt qualify for a non-immigrant visa, sorry to say but they were right, you can only get a non-immigrant visa if you have no intentions of moving to the states on a permanent basis.

        djcabor: Ignore the California processing dates for K-1's! It is very incorrect and has not been updated for a long time.

        Basically, a new law was passed last year that took effect in march. The us gov told petitioners to keep filing, using the old forms. However, they stopped processing all of the petitions that used that old, out of date form, until the new forms were created (June of 2006). The petitions that were filed (roughly 10,000 of them according to the USCIS) were stopped and a "RFE" (request for evidence) sent out and returned. Then petitions that used the new (June 2006) forms were/are being processed "normally" not really delayed, but the petitions that used the old forms were. Almost all of the service centers sent their petitions to the California's service center for processing. Once the RFE was returned, the petitions were sent to the NVC.

        Right now, the NVC and the various embassy's are overwhelmed with the massive amounts petitions to be processed. My petition was sent off in April. I received the RFE at end of June. Returned it July 4. The petition was sent to the NVC at end of July. It was received approved by the NVC on Aug 7, and sent to the Embassy on that date. The Manila Embassy got it on Aug 15.

        There is no "order" for the visa being processed. There are some people who filed petitions in July with the new form I-129f that have already had their interview! I know of other people that had their interviews scheduled already that filed after our I-129f was.

        Hopefully my fiance will have her interview schedule real soon.

          I-130 form approved BEFORE k3 visa interview, what can I do??

          Hey guys,

          I was filing for K3 visa, however I-130 form has been approved BEFORE the K3 visa interview appiontment. Does it mean that K3 visa is no longer eligible? So does it mean that consular will switch from K3 visa to IR (green card) visa for the interview? Should I be physically presented for my husband's (my husband is in Philippines) interview? What about my job? I dont want to lose my job if I have to show up for the interview. Will it be more likely for IR visa interview to be granted at USA embassy in Manila? What kind of STRONG evidence should my husband show to USA embassy consular officer? email messages, letters, bank joint account, photography, wedding picture (civil ceremony ok?). Please let me know! Thanks.

            Yeah, I have similar experience!!!! I remember spending time with my husband in Philippines, trying to get tourist visa, but his tourist visa was being turned down and was being told to apply for K3 visa, not tourist visa. So, it was hardest decision for me to make that I had to return back to USA to file K3 visa, but it is worth it. It takes patience and time, but soon you both will be together! I haven't seen my husband for 4 months, but I am still counting the days left till I see him!

              Hey I have news for you. me and my husband got married in Philippines in Dec. 29, 2005, then I file the k3 visa on April 20, 2005, then K3 visa was approved on July 31, 2005. So, it took about 4 months to get it approved. I am still WAITING TO get appointment date for K3 visa which would be "available" in November, but not sure WHEN EXACTLY in November.

                Actually, if you marry spouse in its country, it is much faster to get green card after getting k3 visa.
