  • K1 or Not?

    Trying to help a friend here. I've already done the whole K1 Visa and my wife and I are happily married and going on 6 years

    I have a friend that is a Green Card Holder and has just became engaged. He wishes to bring ????? to America from Cambodia. Since he remembers me going through the process; he came to me for help.

    Now, I've read soooo many different articles on this and I'm now more confused than ever.

    Does he or does he not file a I-129F? If not, which form does he file?

    Does he go for the K1 Visa or did I read something about a V Visa or would this had been easier if he would have married her then brought her here?

    Sorry for the lack of information, my world revolves around the lack of information.

    Totally lost and confused..... but thank you if you can help out.

    The K-1 would not be suitable for him as it is meant only for the US citizens. So either he caj wait for the naturalization and then go for the K-1 visa for his fiancee.
    Alternatively, The V1 visa is a nonimmigrant visa which allows foreign national spouses of U.S. Legal Permanent Residents to enter into the U.S. and await the availability of an immigrant visa.

    To qualify for V-1 visa, you must be:

    1. The spouse of a Legal Permanent Resident

    2. The beneficiary of Form I-130, Petition for Alien Relative, filed on or before December 21, 2000

    3. Waiting since the last three years at least for an immigrant visa, whether due to processing delays or unavailability of a visa number and

    4. Otherwise eligible to immigrate to the U.S.

    She may stay in the U.S. on V-1 visa for an initial period of two years. She may apply for further extension of stay of two years if a visa number is not yet available. The total number of years she may stay on V-1 visa is 10 years.

    Then also I suggest you to consult a lawyer before you move on.
