I am a native US Citizen. I got married in India in January ‘06 to an Indian National. My wife has never been to the US and is currently is in India.
Back in April ‘06, I applied for a K3 visa (130 & 129F) for her. Since then both petitions (130 & 129F) have been approved. I also filed 864 with the NVC. The NVC sent my wife’s petition to the US Embassy in New Delhi. My wife’s interview date is coming up at the end of January ‘07. I have a few questions.
These questions are based on my very limited knowledge about the immigration process so please bear with me.
1-The K3 visa is a non-immigrant visa, correct?
2-Is there such a thing as a K3 immigrant visa?
3-Given that her 130 was approved while she was in India. Is she no longer able to apply for a K3 non-immigrant visa? Does she have to change to an immigrant visa? What happens when your 130 is approved while abroad?
4-I have already submitted 864 to the NVC. Do I have to submit 134 too?
5-With her 130 already being approved, when she arrives in the US, does she have to file 485?
6-Why does she have two separate case numbers at the US Embassy abroad? One for the 130 and the other for the K visa.
In addition, the Packet-3 they sent her included DS-156 when they claimed via e-mail that she needs to submit DS-230, Part I. I think we are running into these issues because her 130 was approved while she was abroad.
